Equity and Trusts (Advanced)
Module code: LW3370
When a person wishes to benefit others, whether they are individuals, charities or simply 'causes', he or she may use the machinery of a 'trust'. In this module you will look at the making and breaking of trusts, and at the position and duties of trustees. Some of the topics covered will be:
- The nature of the equitable jurisdiction and its continuing impact upon English law, with reference to discrete several different areas of law
- Requirements for creating a valid trust, along with the trustee's duties
- What can be done when things go wrong, and there are disputes
- Situations in which trusts occur informally and how the law governs these areas
