CCTV privacy notice

The Security Department is part of the University of Leicester Estates and Campus services Division.

The University of Leicester is the Data Controller.

This privacy notice explains how we use your personal information and your rights regarding that information.

What information are you collecting?

The security department collects and temporarily stores CCTV images obtained in the form of video images or still images.

Why are you collecting my data?

To assist in providing a safe and secure environment for the benefit of persons using the University estate in creating a safer community.
To reassure, support and improve the experience of students, staff and visitors to the University estate.
To detect, prevent and reduce the risk of incidents of crime on the University estate.
To assist in the identification, apprehension and prosecution of offenders by securing evidence to the required standard to support criminal, civil and internal proceedings.
To detect, prevent and or reduce the incidents of anti-social behaviour.
To assist in Health and Safety requirements and statutory obligations.
To assist in the monitoring, management, deployment and safety of staff on normal duties and when dealing with incidents.
To provide assistance to Emergency services.
To support the control and management of traffic and parking on the University estate.
To assist in the identification and confirmation of breaches of University Charter, Statutes, Ordinances and Regulations.

How will you use this data?

What is the legal basis for processing the data?

The legal basis the University of Leicester is using for processing personal data is ‘legitimate interests’.

If you are sharing my data with others, who are you sharing it with?

Disclosure of CCTV footage to third parties will only take place according to the Data Protection Act 2018 and the General Data Protection Regulation 2016/679. It may also take place in accordance with other UK legislation including the Regulation of Investigatory Powers Act 2000 and the Human Rights Act 1998. This type of processing will only be carried out with the permission of the Head of Security or Information Assurance Services.

Third party viewing requests can be received from the following (this is not an exhaustive list):

UK Police forces (including Ministry of Defence and Military Police)
Statutory authorities with powers to prosecute, (HMRC, Councils, Trading Standards, Environmental Health etc.)
Solicitors or their legal representatives in either criminal or civil proceedings
Individuals representing themselves in judicial proceedings
Other agencies according to their purpose or legal status (i.e. Insurance companies)

Images may be disclosed to the Police even if the system that captured the image was not set up under the operational requirement for prevention and detection of crime, if failure to disclose would compromise a criminal enquiry, the apprehension or prosecution of offenders.

Images will not be share with the media for entertainment purposes or placed on the internet or any social media sites.

Images will not be released to countries outside of the EEA (unless compliant with the ICO regulations).

Images will only be released to the media in liaison with the Police or other enforcement agency for the purpose of identifying offenders and in no circumstances without permission of Head of Security or Information Assurance Services.

If there is any doubt with any application the request will be forwarded to Information Assurance Services for their consideration.

How long will you process my data for?

The footage will be held for 30 days after the initial collection date on our CCTV system. After this period the footage will be permanently deleted unless there is a legal requirement to retain and/or a legitimate reason e.g. police investigation or insurance purposes.
