The Practice of International Commercial Arbitration

This module builds on the theoretical knowledge of international commercial arbitration that you have gained in the first term International Commercial Arbitration module, by teaching aspects of arbitration practice. This will enable you to deepen their understanding of how arbitration works, and why the practices have developed that currently dominate the field, thereby giving you a deeper understanding of the field than is possible from a course concentrating solely on the legal structure of international commercial arbitration.
The module has been co-designed by the module convenor, an arbitration practitioner himself, and two leading international commercial arbitration practitioners, Matthew Parish, Managing Partner of Gentium Law, and Jay Alexander, Chair of International Arbitration and Dispute Resolution at Baker Botts, to ensure that you receive an “insider’s perspective” on the informal structures that dominate arbitration practice.
It will cover topics such as entry into the field (i.e. not formal requirements, of which there are none, but mechanisms, obstacles, etc.), the roles of arbitral institutions, the selection of arbitrators and conflicts of interest, the drafting of persuasive awards, the challenge of arbitral awards, etc.
