This module looks at the legal framework which regulates the sale and acquisition of land and premises together with issues relating to land tenure policy, estate management disputes and taxation. You will look at residential land use, considering the sale and acquisition from the early stages of taking instructions through the transfer and, in the case of leasehold land, to controlling the management of the land and premises. There will also be aspects of relevant professional regulation. You will have an opportunity to carry out some comparative research relating to other legal systems, especially in other Commonwealth jurisdictions.

  • Freehold conveyancing prior to exchange of contracts
  • Completion of freehold conveyancing
  • Leasehold acquisition and estate management (including management of disputes)
  • Leasehold enfranchisement  

On successful completion of this module you should be able to:  

  • Identify the fundamental principles underlying transfer of ownership and management of land in England and Wales
  • Apply rules and principles to factual situations relating to the ownership and transfer of land completion of real estate transactions; and professional regulation including rules relating to land registration, solicitors’ conduct and accounts, money laundering and financial services
  • Identify issues which impact on the management and ownership of land in England and Wales and critically evaluate the suitability of differing ownership or tenure of land for a client’s needs
  • Communicate clearly in oral presentation of advice including the ability to tailor advice to a particular client’s needs based on legislation, case law and/or regulatory rules
  • Communicate clearly in writing, including financial literacy and the ability to use legislation, case law and regulatory rules
